EB-1C: Multinational Executive or Manager

Brief Introduction 

• A qualifying relationship must exist between the foreign employer and the U.S. employer
• Such a relationship exists when the U.S. employer is an affiliate, parent or a subsidiary of the foreign firm, corporation, or other legal entity
• The petitioning employer must be a U.S. employer
• The employer must have been doing business for at least 1 year, as an affiliate, a subsidiary, or as the same corporation that employed the beneficiary abroad​
• The beneficiary must be employed in a managerial or executive position

Advantages

• Visas are mostly immediately available for those who qualify
• May file with premium processing, shortening the processing time 

​Timeline

• I-140 Application (Immigrant Petition for Alien Worker): 6-8 months – no premium processing option available
• I-485 Application (Permanent Residence Application): 6 months​
• Can submit both at the same time. But if I-140 is rejected then your I-485 form will be automatically rejected as well
